Terms & Conditions of Sale

These terms and conditions of sale (the “Terms”) govern all sales concluded on the XPRIVÉ website between the seller identified in section 1 and any consumer customer. Placing an order implies full acceptance of the Terms in force on the day of the order.
This translation is provided for convenience. In case of discrepancy, the French version (« Conditions Générales de Vente ») prevails.
1. Seller identification
The XPRIVÉ website is published and operated by: XPRIVE SAS — 943 293 167 R.C.S. Paris — Siège social : 200 rue de la Croix Nivert, 75015 Paris — Email : support@xprive.com.
2. Products
XPRIVÉ offers designer and premium-brand fashion items at outlet prices. Products are authentic and sourced from selected partners.
Photographs and descriptions are as faithful as possible but minor variations (shade, screen rendering) may exist. Offers are valid while stocks last; availability is re-checked at the time of payment.
3. Prices
Prices are expressed in euros (EUR), all taxes included, excluding delivery costs. Delivery costs depend on the destination country and the chosen method and are displayed before the order is confirmed.
The crossed-out price shown next to the selling price is the reference recommended retail price. XPRIVÉ may change its prices at any time; the price charged is the one displayed at the time of the order.
4. Orders
An account is required to order. The process: cart → choice of delivery method and addresses (or pickup point) → summary → secure payment. The order is final only once payment is confirmed; a confirmation email listing the items, amounts and delivery details is then sent.
XPRIVÉ reserves the right to refuse or cancel any abnormal order, any order placed in bad faith, or in case of a prior dispute.
5. Payment
Payment is made online, in euros, by card via the secure Stripe platform. XPRIVÉ never has access to your full card details. The order is charged immediately; if stock reservation fails after payment, the customer is contacted and refunded where necessary.
6. Delivery
XPRIVÉ delivers to 27 European Union countries. Depending on the country, the available methods are: Colissimo home delivery (with signature), Colissimo pickup point, and Mondial Relay pickup point. For pickup deliveries, choosing the point is mandatory at checkout.
Indicative delivery times, displayed at checkout, range from 8 to 17 days depending on the destination country, starting from order confirmation.
Territorial restrictions: metropolitan France only (Monaco included; overseas territories excluded), Spain excluding the Canary Islands, Portugal excluding Madeira and the Azores.
If a parcel arrives damaged or incomplete, the customer must note reservations with the carrier and contact XPRIVÉ as soon as possible.
7. Right of withdrawal
In accordance with EU consumer law, the customer has 14 days from receipt of the order to withdraw, without giving any reason.
Requests are made via the contact page or by email. Items must be returned in their original condition (unworn, unwashed, labels attached, accessories and packaging included). Return shipping costs are borne by the customer.
The refund is issued no later than 14 days after the items are recovered (or proof of shipment is provided), using the original payment method, and includes the initial standard delivery costs.
Legal exceptions: hygiene and cosmetic products unsealed after delivery cannot be returned for hygiene reasons.
8. Legal warranties
All products are covered by the legal warranty of conformity (2 years from delivery under French consumer law) and the warranty against hidden defects (French Civil Code).
In case of non-conformity, the customer may request repair or replacement, or failing that a price reduction or cancellation of the sale, free of charge.
9. Liability
XPRIVÉ cannot be held liable for non-performance caused by force majeure, by the customer, or by an unforeseeable and insurmountable act of a third party. XPRIVÉ's liability is in any event limited to the amount of the order concerned.
10. Personal data
Personal data collected with the order is necessary to process it (order management, delivery, invoicing, fraud prevention) and is processed in accordance with the GDPR. Customers have rights of access, rectification, erasure and objection, which can be exercised via the contact page.
11. Governing law and disputes
These Terms are governed by French law. In case of a dispute, the customer should first contact XPRIVÉ customer service to seek an amicable solution.
In accordance with the French Consumer Code (articles L.612-1 et seq.), the customer may use free consumer mediation to resolve the dispute amicably. The contact details of the competent mediator are provided on request from customer service (support@xprive.com).
